Wellsford Water - Terms and Conditions​

The following terms govern your use of Wellsford Water website and services. By accessing this website you (the "Customer") are deemed to accept and agree to be bound by these terms. If you do not accept these terms then you may not access or use this website.

In booking a water delivery through Wellsford Water you are hereby accepting the following terms and conditions;

1. Payment

Prepayment is required before we will deliver.

2. Cancellations

Cancellations and rescheduling of supply can be made up to 24 hours before a scheduled delivery.  Cancellations made after this time will incur a $50 administration fee. If no notice of cancellation or rescheduling has been provided and we arrive on site, or are en route, you will be invoiced in full for the delivery.

In most cases we can reschedule delivery, however in periods of extreme demand such action may result in your delivery being delayed as we attend to other orders in the queue.

3. Delivery Time

Any time or date or date given by Wellsford Water to the Customer is an estimate only. The Customer must still accept delivery of the goods even if late and the Wellsford Water will not be liable for any loss or damage incurred by the Customer as a result of the delivery being late.

4. Access

The Customer shall ensure Wellsford Water has clear and free access to the delivery site at all times to enable them to deliver the goods. Wellsford Water shall not be liable for any loss or damage to the Customer's property (including, without limitation, damage to driveways and concreted or paved or grassed areas or bridges or septic systems) unless due to the negligence of the Wellsford Water. The Customer must inform the Wellsford Water if they have a septic system located in the area where the truck is expected to operate.

The exception to this would apply where the damage was caused by the negligence of Wellsford Water. The onus is on the customer to inform Wellsford Water of any septic system within the area of where a truck will need to be placed to efficiently deliver water.

5. Risk

Goods supplied are sourced solely from a registered drinking-water supply which complies with the current DWSNZ. The Customer accepts and acknowledges that the goods may have a noticeable smell or taste due to the treatment process.

6. Disclaimer & Limitation of Liability

Information on this website is provided ‘as is’ without warranty of any kind, either express or implied. While every effort has been made to provide the most accurate information available we advise that information on this website may contain technical inaccuracies or typographical errors.

Wellsford Water may at any time and without notice make improvements and/or changes in this information. To the fullest extent possible and subject to applicable law, Wellsford Water disclaims all warranties, express or implied as to the material and information on this website and the operation of this website. Wellsford Water does not warrant that the functions contained in this website will be uninterrupted or error free, that defects will be corrected or that this Site or the server that makes it available is free of any virus or other harmful elements.

Wellsford Water will not be liable to any party for any direct, indirect, special or other consequential loss or damage arising out of the use of or inability to use, or reliance on any information contained on, or accessed through this website, including without limitation, any lost profits, business interruption, loss of programs or other data on your information handling system or otherwise, even if Wellsford Water is expressly advised of the possibility of such loss or damage. If for any reason Wellsford Water is responsible for any damage or harm arising out of your use of this website, in no event shall Wellsford Water’s total liability to you for all damages, losses, and causes of action (whether in contract, tort or otherwise) exceed the sum of NZ$100.

7. Jurisdiction

These terms of use shall be governed by and construed and interpreted in accordance with the laws of New Zealand.

8. Modification

Wellsford Water reserves the right to amend these terms at its discretion at any time. Any change will be posted on this website and will apply as from the date such amended terms are posted on this website.
